An American Idol Winner Is Trying To Get Out Of An Onerous Reality TV Contract

Reality TV contracts are notoriously onerous but it is very rare for these the conditions outlined in these contracts to ever be tested. Phillip Phillips, an American Idol winner is going to test them as he is trying to get out of his contract with 19 Entertainment aka Simon Fuller. He is saying the contract is “oppressive and fatally conflicted”.

Reality TV wannabees have little bargaining power so sign to get on the show. To be fair for the majority of reality TV contestants the contracts have end up having little or no impact but in Phillip’s case he is saying that 19 Entertainment have   forced him to perform for free for one of Idol sponsors and not even knowing the title of his last album before it was announced publicly.

Unfortunately the case won’t be testing how conscionable some of the contract terms in reality TV contracts are but will be running it under the Talent Agencies Act which states licensed talent agents can procure employment for clients.

The Hollywood Reporter states:

Before Idol viewers voted him the winner that year, Phillips signed a series of contracts governing his management, merchandising, recording and publishing. The deals are quite favorable to 19 Entertainment, a company founded by Simon Fuller that also produces other shows such as So You Think You Can Dance. For example, according to the complaint, when Phillips does endorsements, 19 gets as much as a 40 percent cut.

Nevertheless, Phillips tells the California Labor Commissioner that 19 has a fiduciary duty to him, and that the company has breached such duty by compelling him to take jobs that are of benefit to the company and its affiliates rather than to him.

Similarly, Phillips says he performed at a corporate event for an insurance company — only it was labeled an endorsement deal. Raising a problem with this gig, he says 19 took the position that it was subject to the Merchandise Agreement, with a 40 percent commission. Phillips argues, “If Respondent was truly putting Petitioner’s best interest above their interests, Respondent should have taken the position that the performances should be commissioned at the 20% commission rate provided for in the Management Agreement.”

The petition also chronicles other indignities that Phillips has faced in the past couple of years. He says that 19 lined up a producer for his first two albums that compromised his interests. He says 19 lied to him, saying that the producer wouldn’t receive greater mechanical royalty rates than he would. He adds that 19 has repeatedly withheld information regarding his career, including the title of his Behind the Light album released last year.

The Block – One Team Out

After the usual last minute rush of the teams finishing the rooms which included a carpet and wallet debacle for Tim, a late delivered bed and Aimee missing in action at the shops half an hour before reveal.

Tim and Anastasica finished room did not have the TV on the wall in the end. Neale Whittaker and Darren Palmer were the judges and they loved the art work of own American Indian in a traditional head dress. Darren did not like the wooden feature wall as it was not finished. He also did not like the bed head that it was too big and did not leave a decent gap to get past the bed.

Aiden and Jess’s room was great it looked light and airy. Neale thought it was a sophisticated room. They also loved the wardrobe. They were criticised for their paint work.

Mark and JJ’s room was very cluttered. The judges liked their wallpaper, I thought it gave the room a closed in feel. The judges did not think the furniture went together. Darren thought there were four different styles in the very small room. Neale said it was chaos.

Aimee and Brooke’s was quite sparse but it because the room was small it had a more spacey feel. Neale really liked it he thought it was industrial country style. Darren loved the wardrobe but did not like the bent curtain rod.

The WA siblings, Ebony and Luke, were the only ones to place the bed facing away from the window. The dark blue walls were good and surprisingly did not give the room a claustrophobic feel. They did not like the chest of drawers not the scrappy skirting boards. The room was unfinished.

The judges loved Josh and Charlotte room. Neale thought it was industrial beach. They loved the lime wash timber feature wall. Neale was gushing saying it was “superb”. Darren was not happy there was no window treatment which is layman’s terms is either a curtain or a blind. But in the end it did not matter as they came in first.

Second place was Aimee and Brooke, which I was a tad surprised about. Aiden and Jessica moved into the next round as well as Ebony and Luke.

The bottom two were Tim and Anastasia and Mark and JJ. It was NSW team Mark and JJ were sent home. Well at least this now means there are not two Jessica’s on The Block anymore.

The scores were:

Josh and Charlotte 17 1/2

Aimee and Brooke 17

Ayden and Jessica 16 1/2

Luke and Ebony 15

Tim and Anastasia 14 1/2

Mark and Jessica 14.

Lara Bingle posts an instagram photo of herself in a pool in a bikini with a belly and everyone is now saying the pregnancy is confirmed. She might be pregnant but she does not look like she is due in February or March if going by the start date of the rumours which was in June last year.  If the media did not salivate over Lara’s cryptic social media posts maybe she would stop posting them. But we do and they get clicks so Lara cleverly uses the interest in her to gain publicity. (Source: Lara’s Instagram)

Skye Wheatley, Big Brother runner up from 2014 is not just content to have plumped up lips, she wants plumped up boobs and is in Bangkok and was going to go the full DD implants but she was told she will have to stick to D Cups as her body was too small to cope with the DD’s. So first world problems in a third world! (Source: Daily Mail)

It looks like Lisa Hyde won’t be The Bachelorette on TEN. The runner-up in last year’s The Bachelor has a new boyfriend. Her BFF Sam Frost also won’t be The Bachelorette either as she has a rumoured new boyfriend as well. (Source: Daily Mail)

The reason Dan Reilly is Keith the foreman’s new fore boy on The Block is that at the end of the previous series Keith was sick and exhausted so Dan will take some of the pressure off him. However considering Dan has just qualified as a builder I question how much experience he will have. (Source: Daily Telegraph)

Bear Grylls will be fronting a Celebrity Survival reality TV show. He takes eight celebs out into a jungle. Not sure it will be screened in Australia. (Source: Telly Mix)

Confirmed Paula Abdul and Jason Derulo will be judges on the new series of So You Think You Can Dance. Considering they could not pull in the ratings when they were on Australian TV shows, it will be interesting if they can bring a revival to the format in the US. Nigel Lythgoe remains on the panel. Addicted to Pawn Stars, Storage Wars or American Pickers well apparently watching these shows help you negotiate better. There you go reality TV is educational. (Source: Mainstreet)

New Reality Food Show Coming To NINE Later This Year

When I read that NINE was going to produce a cooking reality show this year I thought they might be finally doing an Australian version of The Taste, the US show that stars Anthony Bourdain and Nigella Lawson.

However this is not the case.

TV Tonight is reporting the new food show will be “set in restaurants”. TV Tonight says he has heard whispers that the format will see teams travelling the country to dine in and score each others’ restaurants.

NINE is the only commercial free-to-air channel that does not have a cooking show in its reality TV basket.

SEVEN has a new cooking show this year called Restaurant Revolution which looks like it will be similar to their previous show My Restaurant Rules.

Considering food reality is probably my favourite genre I will be watching it.
